By using the Kelpr website and services ("Services"), you agree to these Terms. If you do not agree, do not use the Services.

2. Description of services

Kelpr provides customer communication software for businesses, including tools for service-related notifications, support follow-ups, post-interaction feedback workflows, and operational messaging. The Services are intended for non-promotional, service-oriented use consistent with applicable law and carrier requirements. Customers are responsible for message content, consent, and compliance with rules governing SMS and other channels.

3. Acceptable use

You agree not to use the Services to:

  • Violate law or third-party rights
  • Send unsolicited promotional or deceptive messages
  • Circumvent consent, opt-out, or carrier requirements
  • Transmit content prohibited by carriers or applicable regulations
  • Interfere with or disrupt the Services or other users
  • Attempt unauthorized access to systems or data

4. Accounts

You must provide accurate registration information and safeguard your credentials. You are responsible for activity under your account.

5. Fees

Paid features, if any, will be described in an order form or invoice. You agree to pay fees as agreed. We may change pricing with notice where required.

6. Intellectual property

Kelpr and its licensors own the Services and related intellectual property. You receive a limited license to use the Services per these Terms.

7. Third-party services

Integrations (e.g., business systems, carriers) are subject to third-party terms. We are not responsible for third-party services.

8. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KELPR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM THESE TERMS OR THE SERVICES.

10. Termination

We may suspend or terminate access for violation of these Terms or for other operational reasons. You may stop using the Services at any time.

11. SMS

SMS-related practices are further described in our SMS Terms.

12. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law rules, except where prohibited.
